3. Medical Emergency

IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR LOCAL EMERGENCY SERVICES (e.g., 911 in the United States, 112 in Europe). DO NOT USE THE APP OR RELY ON AI-GENERATED CONTENT FOR EMERGENCY SITUATIONS.

4. AI-Generated Content and Limitations

AI-Generated Content: You acknowledge and agree that all content, interpretations, responses, and educational information provided by MedScan AI are generated by artificial intelligence using Google's Gemini models. The educational content is created algorithmically and not by human medical professionals which is stated clearly in the app's disclaimers.

Potential for Errors: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS, INACCURACIES, OMISSIONS, OR OUTDATED INFORMATION. The AI models may:

• Provide incomplete or incorrect interpretations;
• Generate information that does not apply to your specific situation;
• Fail to account for individual medical history, allergies, or contraindications;
• Produce content that may be misinterpreted.

No Warranty on Accuracy: The content should be treated as educational material only and verified with qualified healthcare professionals.

5. No Professional Advice and Assumption of Risk

The Company, Developers, its contributors, employees, affiliates, and licensors are not healthcare providers and do not render medical services. By using the App, you expressly assume all risks associated with:

• Relying on AI-generated content for any purpose;
• Making health-related decisions based on information from the App;
• Delaying or failing to seek professional medical advice;
• Misinterpreting any content provided through the App.

YOU ARE SOLELY RESPONSIBLE for all decisions, actions, and outcomes related to your use of the App and any reliance on its content.

6. Limitation of Liability and Release

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App;
• Any action taken based on content generated by the AI;
• Any medical outcomes, injuries, or health conditions arising from your use of the App;
• Any errors, inaccuracies, or omissions in AI-generated content;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from the App.

YOU HEREBY RELEASE THE DEVELOPER FROM ANY AND ALL LIABILITY arising from or related to your use of the App, including any claims for medical malpractice, personal injury, or wrongful death. You waive any right to bring a claim against the Developer related to any medical decisions or outcomes associated with your use of the App.

7. Subscription Management and User Responsibility

User Responsibility for Subscriptions: YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR MANAGING YOUR SUBSCRIPTION, INCLUDING:

• Creating, activating, and maintaining your subscription;
• Monitoring your subscription status and renewal dates;
• Canceling your subscription before it renews if you do not wish to continue;
• Ensuring you have the necessary authorization to use the payment method provided;
• Updating your payment information as necessary.

Automatic Renewal

Subscriptions automatically renew at the end of each subscription period (after 3-Day Free Trial, weekly, monthly, or annually) unless canceled at least 24 hours before the renewal date. You authorize App Store / Google Play to charge the subscription fee to your selected payment method at the beginning of each renewal period.

NO REFUND FOR UNUSED PORTIONS: YOU WILL NOT RECEIVE A REFUND FOR ANY UNUSED PORTION OF YOUR SUBSCRIPTION PERIOD IF YOU CANCEL DURING AN ACTIVE SUBSCRIPTION PERIOD. You will continue to have access to the subscription benefits until the end of the current billing period. Subscription payments are fully handled by App Store / Google Play, and all cancellations and refunds are subject to their respective policies. Please refer to the App Store / Google Play terms for more information on their refund policies, the developers have no control over payment authorization, billing, or refund processes.

FORGOTTEN CANCELLATIONS: THE DEVELOPER IS NOT RESPONSIBLE IF THE USER FORGETS TO CANCEL SUBSCRIPTION BEFORE THE RENEWAL DATE. It is your sole responsibility to remember cancellation deadlines and manage your subscription through your device's settings (Apple App Store, Google Play Store, or other applicable platform). App Store / Google Play provide notifications about upcoming payment renewals, but it is ultimately your responsibility to ensure timely cancellation if you do not wish to continue the subscription. The Developer is not liable for any charges incurred due to missed cancellation deadlines or failure to manage your subscription properly.

All billing and subscription management for in-app purchases is handled by the respective application stores (Apple App Store, Google Play Store) and is governed by their terms and conditions. The developer of the app has no control over and assumes no responsibility for any billing errors, payment processing issues, or subscription management features provided by third-party stores (App Store or Google Play Store).

Subscription Terms

The following terms apply to subscriptions:

• Free trials are available for new users and are limited to one free trial attempt per user (usually 3-Day Free Trial, then weekly subscription starts automatically, the user can cancel anytime). Additional free trials are not permitted.
• Weekly subscriptions are billed every 7 days
• Monthly subscriptions are billed every 30 days
• Annual subscriptions are billed every 12 months

Fee Changes

The Developer reserves the right, in its sole discretion, to modify subscription fees at any time. Any fee change will become effective at the end of the then-current subscription period. Your continued use of the App after the fee change constitutes your agreement to pay the modified subscription fee amount.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the country where the Application was developed (ROU), without regard to its conflict of law provisions.

10. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and the Developer / Company regarding your use of the App and supersede all prior agreements and understandings.

11. Changes to Terms

The Developer reserves the right, at its sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the App.

12. Acknowledgment of Understanding

BY USING MEDSCAN AI APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU SPECIFICALLY ACKNOWLEDGE THE TERMS ABOVE AND UNDERSTAND THAT:

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
